The City frequently is asked to abandon a public right-of-way, recorded plat or public utility easement so the land can be put to another use. The process, accomplished by city ordinance, is called vacation. The vacation of streets, alleys, plats and easements are done under the authority of the City Council following review by several City Departments and private utilities companies.  This process could take up to one to one and half months, depending on the complexity of the request.  

Before Submitting

Before submitting your application, please be sure to submit ALL of the required documents as shown on the checklist in the application and Land Development Code Sec. 300.06.  An incomplete application will not be processed.

FAQ's

  1. When do I need to apply for an Easement/Alley Vacation?
    • Please read SC 300.6, link is provided under the "Regulatory" section of this webpage.  This process is started by the property owner due to wanting to use the land for another use that would not be allowed if the easement or alley was to remain.
  2. What documents are required for submission?
    • Please read SC 300.6(B) and review the Easement/Alley Vacation Application.  A list of items required is included in both areas.  Please note that only complete applications will be processed, so be sure that you double check the items required.
  3. How long does the process take?
    • Depending on the complexity of the request, the process could take one to one and a half months to complete.  This would include City department reviews, private utilities reviews and submissions to City Council.  
  4. What if I am not happy with the outcome of my request?
    • Please read SC 300.7 "Appeals".  Appeals of interpretations of the Subdivision
      Regulations may be made to the Board of Adjustment in accordance with the procedures set forth in the Zoning Ordinance.
